1. Scope

These Terms and Conditions govern the use of the ‘BrewMemo’ app (hereinafter referred to as “App”) from BrewCode GmbH (hereinafter referred to as ‘Provider’). By installing and using the App, you agree to these Terms and Conditions.

2. Licence

  1. The Provider grants you a non-exclusive, non-transferable licence to use the App on your device.
  2. The App may be used by both private individuals and business customers.

3. Premium features

  1. The App can be used in a free basic version. Premium features require a paid licence.
  2. The fees for the premium features are billed via the respective app stores.
  3. The scope of the premium features can be viewed in the App.

4. Refund policy

  1. Right of withdrawal: You have no right of withdrawal once you have started to execute the contract (e.g. by downloading or activating the app) and have expressly agreed that you lose your right of withdrawal. This only applies if you were informed of the loss of your right of withdrawal before the contract was concluded.

  2. Warranty for defects: If the app or digital content does not function as agreed, you are entitled to free repair or, if this is not possible, a refund or price reduction. You must report defects within 2 years of receipt.

  3. Subscriptions: You may cancel subscriptions at any time. In the event of early cancellation, you will receive a pro-rata refund for unused periods, unless otherwise agreed.

  4. Platform-specific returns: In addition to these statutory rights, the return policies of the respective platform (e.g. Google Play, App Store, Paddle) apply.

5. Data protection

  1. The provider collects and processes personal data in accordance with the applicable data protection regulations. Details can be found in our privacy policy.
  2. The app may use cookies and similar technologies. By using the app, you consent to the use of such technologies.

6. Disclaimer

  1. The app is provided ‘as is’ and without warranty.
  2. The provider is not liable for any loss or damage resulting from the use of the app.

7. Changes and termination

  1. The provider reserves the right to change or discontinue the app or parts thereof at any time.
  2. You can uninstall the app and terminate its use at any time.

8. Miscellaneous

  1. These Terms and Conditions are subject to German law.
  2. The place of jurisdiction is the provider’s registered office.
